Version 1, effective Oct 27, 2026
This Participant Waiver & Release of Liability ("Waiver") applies to everyone who plays at, trains at, or attends Duelo Battleground (the "Venue"), located at Lot 18 Block 20 J. De Veyra Street, Carreta NRA, Cebu City, Cebu 6000, operated by Apex Sports, Inc. ("Duelo", "we", "us").
You accept this Waiver with its own checkbox when you book a court online, the first time you book and again whenever we publish a significant change to it. Please read it carefully: badminton is a physical sport, and by playing you accept its risks.
This Waiver sits beside our Terms of Service and our Booking, Payment & Facility Terms ("Booking Terms"), which contain the court rules and the rules on conduct referred to below.
1. Summary of the key points
This summary is for convenience; the full sections below govern.
Badminton carries a risk of injury, including sprains, fractures, eye injuries and, rarely, serious medical events.
You play voluntarily and at your own risk, and you confirm you are fit to play.
Stop and tell the front desk straight away if anyone is hurt or feels unwell, or if you see a hazard.
We remain responsible for our own negligence. This Waiver never excuses negligence, wilful misconduct or fraud by Duelo or its staff.
The Booker answers for their Group: they must tell everyone who plays under their booking about this Waiver.
2. Who this Waiver covers
Account holders accept this Waiver for themselves at checkout: with their first online booking, and with their next booking after a significant change to it.
The Booker (the person who makes a booking) confirms they have told every person who plays or attends under that booking (their "Group") about this Waiver, and accepts it on behalf of any member of their Group who has not accepted it themselves.
Front-desk bookings: our staff make walk-in and phone customers aware of this Waiver before completing the booking.
Participants under 18 may play only with the involvement and consent of a parent or legal guardian, who accepts this Waiver on their behalf, as set out in the Terms of Service. A player under 12 must be accompanied at the Venue by a parent, guardian or responsible adult at all times.
Trainers are responsible for making sure every student they bring (or the student's parent or guardian) is aware of this Waiver.
3. The risks of the sport
Badminton is a fast, physical sport. Playing, training, or being on or near a court carries a risk of injury and illness, including:
sprains, strains, and muscle, tendon and ligament injuries (including Achilles tendon and knee injuries);
fractures, dislocations and joint injuries;
slips, trips and falls, including on a court surface that becomes slippery with sweat or spilled drinks;
collisions with other players, the net posts, walls or equipment;
eye and facial injuries from a shuttlecock or racket;
dehydration, heat exhaustion and fatigue; and
rarely, serious injury or medical events such as heart problems, which can occur even in people who feel healthy.
Some of these risks cannot be removed by any amount of care on our part, because they are part of the sport itself.
4. Your confirmation
By accepting this Waiver, or by playing at the Venue, you confirm that:
you understand these risks and voluntarily accept them;
you are, to the best of your knowledge, physically fit to play, and you have no medical condition that makes playing unsafe for you — or, if you do, you have taken appropriate medical advice;
you will not play while ill, injured, or under the influence of alcohol or drugs; and
you will play within your ability and follow the court rules in the Booking Terms and the instructions of Venue staff.
5. Playing safely
Warm up before you play and cool down afterwards.
Wear non-marking court shoes and suitable sports clothing. Players bring their own rackets and shuttlecocks; check that your equipment is in good condition.
Protective eyewear is recommended, especially for children and doubles play near the net.
Stay hydrated and take breaks.
Keep the court clear: bags, bottles and spectators stay outside the playing area.
Stop playing and tell the front desk straight away if you or anyone else is hurt or feels unwell, or if you notice a hazard such as a wet floor, a damaged net or poor lighting.
6. First aid and medical care
A first-aid kit is available at the front desk. First aid at the Venue is not a substitute for professional medical care, and our staff are not medical professionals.
In an emergency, you agree that our staff may call emergency services and arrange for you to be taken to the nearest hospital or clinic if you are unable to decide for yourself. Any medical, ambulance or hospital costs are your own.
Please tell the front desk about any medical condition staff should know about in an emergency.
7. Personal belongings and vehicles
You are responsible for your personal belongings. We are not responsible for loss, theft or damage to items brought into the Venue, or to vehicles parked at it or their contents, except where caused by our negligence. Items left behind are kept at the front desk for 30 days and may then be disposed of or donated.
8. Release of liability, and its limits
8.1 What you release
To the fullest extent permitted by Philippine law, you release Duelo, the Venue, and their officers, staff and approved trainers from liability for injury, illness, loss or damage arising from your participation in play or your use of the Venue, where it results from the ordinary risks of the sport described in section 3.
8.2 What this Waiver never covers
Nothing in this Waiver excludes or limits our liability for:
our own negligence, or that of our staff, including the condition of the courts, the equipment and the facilities we provide;
wilful misconduct, gross negligence or fraud;
death or personal injury caused by negligence; or
any liability or right that cannot be waived or excluded under Philippine law, including your rights under the Consumer Act of the Philippines (Republic Act No. 7394) and the Civil Code.
8.3 Limit on other losses
Where we are liable for a loss other than death or personal injury, our liability is limited to the amount you paid for the booking concerned, or ₱1,000 if the loss does not relate to a booking, as set out in the Terms of Service.
9. Damage you cause
You are responsible for injury to other people, and for damage to the courts, nets, equipment or facilities, caused by you or your Group through carelessness or breach of the court rules, beyond normal wear and tear (see the Booking Terms).
10. Changes to this Waiver
We may update this Waiver from time to time. The updated version is published on this page with its effective date. When we make a significant change, we will ask you to accept the new version at your next booking.
